How do I obtain an Order for Protection or a Harassment Restraining Order?

Orders for Protection and Harassment restraining Orders are court orders. They prevent a person from having any contact with the person filing the order in person, by telephone, letter or third party. A person violating such an order can be arrested and charged by police with a misdemeanor and subsequent violations may be charged as gross misdemeanors.

Obtaining such an order requires the petitioner to visit the Hennepin County Government Center in Minneapolis. The petitioner will be asked to give their reasons why issuance of such an order is necessary. At that time, a temporary order will be granted for a short period of time until a hearing date can be set up and the respondent served notification. At the hearing date both the petitioner and the respondent will have an opportunity to present their side to a judge or referee as to why the order should or should not be granted.
